Monthly Board Meeting Minutes
December 9, 2008

The Town of Pound monthly board meeting for December 2008 was called to order by Chairman Heroux at 6:13 PM

Chairman Heroux informed the body that the meeting notices had been posted in the three regular posting areas, Town Hall, Recycle Center and Equity Hall.

Motion to accept Paul Mertens request to address the Town Board to explain his business plans to open a gunsmith shop was submitted by Supervisor Risner, seconded by Supervisor Gaffney, carried 5/0.

Motion to approve the December agenda was submitted by Supervisor Risner, seconded by Supervisor Gaffney, carried 5/0

Motion to approve the November 11, 2008 Monthly Town Board Meeting Minutes was made by Supervisor Semrau, seconded by Supervisor Risner, carried 5/0

Treasurer Rymer presented the November 2008 financial report which included the following account balances:
Money Market Account – Associated Bank = $155,686.12
Checking Account – Associated Bank = $2,005.04
Money Market Account – Peshtigo National Bank = $99,386.34
Checking Account – Peshtigo National Bank = $1,000.00
Total = $258,077.50
Submitted on November receipt #’s 4634 through 4649 totaling $72,277.83. Motion to approve was made by Supervisor Risner, seconded by Supervisor Pellman, carried 5/0

Clerk Peterson presented the December 2008 vouchers totaling $15,359.75 (Check # 8579 through Check # 8617). Motion to approve the submitted vouchers was made by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0

Zoning Administrator Peterson submitted Building Permits 2008-31 and 2008-33. Motion to approve the permits was made by Supervisor Risner, seconded by Supervisor Semrau, carried 5/0.


Public Comments:

Paul Mertens explained his business plans to open a gunsmith shop called “American Gunsmithing” on his parent’s property (Robert and Edith Mertens), parcel 028-00776.00 address W7597 County Road M. The gunsmith shop will be housed in an existing maple syrup processing building of approximately 360 sq ft. Business operations will include gun fix and repair, customizing, part making, bluing, welding, bore sighting and limited outside range shooting. Applying for a Federal Firearms License (FFL). A Conditional Use Permit has been requested with the public hearing scheduled on Tuesday, January 6, 2009 at 7;00 pm.

• TEA Project status – extend N 19th Road from County Road Q to W 16th Road:
o A meeting was held on Thursday, November 13, 2008 at 2:00 pm, between Mark Desotel (Marinette County Highway Commission), Chairman Heroux, Clerk Peterson and Kathleen Drews (Wisconsin Department of Transportation). TEA will require proof of payment before vendor invoices can be reimbursed. Kathleen Drews will draft a proposed project plan by mid January 2009.
• Lentz Road project with Town of Brazeau
• A meeting was held on Thursday, November 13, 2008 at 1:00 pm, between Supervisor Pellman, Gerald Kempka – Town of Brazeau and Al Olson - Oconto County Highway Department to discuss Lentz Road bridge and reconstruction issues planned for the 2009 Highway Construction season.
• Project will include two(2) miles north of County Road B and 600 feet south of County Road B
• Culvert / Bridge estimated cost $82.000 with 50% covered by Culvert Aid, 25% charged to Town of Brazeau and 25% ($21,000) charged to Town of Pound
• Cut down hill at intersection of W 16th Road and Lentz Road
• Estimated cost of reconstruction and resurfacing = $85,000 per mile
• Town of Pound estimated share or road reconstruction and resurfacing = $110,000.
• Next meeting planned for January 2009



Plan Commission – Supervisor Gaffney

• Village of Coleman has submitted a list of questions to their attorney to get his response before approving their ordinance to create a joint municipal court and also approve the agreement between the Town of Pound and Village of Coleman on operating the joint municipal court. Approval is now expected during the Village of Coleman monthly board meeting in January of 2009.
• The Plan Committee held a Public Hearing on December 2, 2008 to gather public input on the Peters Concrete Company’s request, on behalf of Allen Noll, to rezone two parcels located off N. 9th Road from A-1 (Agricultural / Rural Residential) to Q-1 (Quarry).
o Town Board will be asked to set a 45 mph speed limit on N 9th Road.
o Town Board will be asked to post “No Jake Brake” usage on N 9th Road and request Marinette County to post the same on County Road Q at the intersections of N 9th Road, E 22nd Road and State Highway 64 East.
o Plan Commission will draft a Road Damage Ordinance and submit it to the Town Board for action.
o Motion to approve the Peters Concrete Company’s request on behalf of Allen Noll, to rezone parcels 028-00587.000 and 028-00589.000 located off N. 9th Road from A-1 (Agricultural / Rural Residential) to Q-1 (Quarry) including stated conditional uses and operational conditions – Resolution R2008-202, was submitted by Supervisor Risner, seconded by Supervisor Gaffney, carried 5/0 on an unanimous roll call vote.
o Next step will be to submit Resolution R2008-202 to the Marinette County Land Information office for their committee approval and final Mariette County Board approval
• Next Plan Commission meeting to be determined

Board of Appeals
• The next Board of Appeals meeting is scheduled on Tuesday, January 20, 2009.

Recycle Center / Solid Waste Collection – Supervisor Gaffney

Animal control – Constable Broderick
• During a special town meeting held at 6:00 pm on Tuesday, December 9, 2008, the town electors approved a motion to abolish the elective position to Town Constable.

Business Issues:

• Motion to approve the Town of Pound Snowmobile Route Designation Ordinance O2008-805, with the additional requirement of the snowmobile club to contact adjacent landowners and inform them of the snowmobile clubs roll in monitoring and policing the trails, was submitted by Supervisor Pellman, seconded by Supervisor Semrau, carried 3/2 with Supervisor Risner and Supervisor Gaffney both voting “NO”.



Business Issues (continued):

• Discussion suggested changing the proposed reservation of Code of General Ordinance - Chapter 9 Municipal Judge and Court Ordinance to Code of General Ordinance - Chapter 8 because Chapter 9 was reserved for the Official Map Ordinance.
o Motion to approve Code of General Ordinance - Chapter 8: Municipal Judge and Court Ordinance - creating a joint Municipal Court with the Village of Coleman was submitted by Supervisor Gaffney, seconded by Supervisor Semrau, carried 5/0.
• Motion to approve the agreement between the Town of Pound and the Village of Coleman for the operation of a joint municipal court was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0.
• Motion to approve purchasing a Laptop Computer, Microsoft Office and Norton AntiVirus software from UES Computers for the Town Treasurer – cost $1,150.00 was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 4/1 with Supervisor Pellman voting “NO”.
• Motion to approve purchasing tax collection and dog licensing software from J. Mauel & Associates for the Town Treasurer – annual fee $450.00 was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0
• Motion to approve the Town of Pound 2009 Budget consisting of Revenues of $394,993 and Expenditures of $403,900 (over spending revenues by $8,907) was submitted by Supervisor Gaffney, seconded by Supervisor Pellman, carried 5/0


Motion to adjourn was made by Supervisor Semrau, seconded by Supervisor Pellman, carried 5/0 @ 8:15 pm
