Monthly Board Meeting Minutes
October 14, 2008

The Town of Pound monthly board meeting for October 2008 was called to order by Chairman Heroux at 6:00 PM

Chairman Heroux informed the body that the meeting notices had been posted in the three regular posting areas, Town Hall, Recycle Center and Equity Hall.

No request to address the Town Board

Motion to approve the October agenda was submitted by Supervisor Risner, seconded by Supervisor Gaffney, carried 5/0

Motion to approve the September 16, 2008 Monthly Town Board Meeting Minutes was made by Supervisor Gaffney, seconded by Supervisor Semrau, carried 5/0

Motion to approve the October 7, 2008 Special Town Board Meeting Minutes was made by Supervisor Risner, seconded by Supervisor Semrau, carried 5/0

Treasurer Rymer presented the September 2008 financial report which included the following account balances:
Money Market Account = $243,193.71
Checking = $1,900.00
Totaling = $245,093.71
Submitted on September receipt #’s 4590 through 4608 totaling $2,385.06. Motion to approve was made by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0

Clerk Peterson presented the October 2008 vouchers totaling $84,921.83 (Check # 8514 through Check # 8544). Motion to approve the submitted vouchers was made by Supervisor Semrau, seconded by Supervisor Pellman, carried 5/0

Zoning Administrator Peterson submitted Building Permits 2008-26 through 2008-28 and Driveway Permits DW08-04, DW08-07 and DW08-08. Motion to approve the permits was made by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0.

Project / Committee Updates:

Marinette County Board Activities - Jerry Pillath not available

Building & Grounds Maintenance – Supervisor Semrau
• New flag poles are being installed at both the Town Hall and Town Cemetery.

Highway Maintenance – Supervisor Semrau

Highway Construction – Supervisor Pellman / Chairman Heroux
• TEA Project status – extend N 19th Road from County Road Q to W 16th Road:
o Special Town Board meeting was held Tuesday, October 7, to review the two (2) lowest bids for engineering proposals to layout roadway options which included 45 MPH curves, 35 mph curves and 90 degree curves. Lowest bidders were Foth and TN&A Associates.
o Motion to accept the engineering proposal of TN&A Associates for $23,500.00 was submitted by Supervisor Gaffney, seconded by Supervisor Risner, motion failed on a voice vote 2/3 (voting: Chairman Heroux = no, Supervisor Risner = yes, Supervisor Semrau = no, Supervisor Gaffney = yes, Supervisor Pellman = no)
o Motion to accept the engineering proposal of Foth for $24,800.00 was submitted by Supervisor Semrau, seconded by Supervisor Pellman, motion carried on a voice vote 3/2 (voting: Supervisor Pellman = yes, Supervisor Gaffney = no, Supervisor Semrau = yes, Supervisor Risner = no, Chairman Heroux = yes)
o Foth engineering proposal will be reviewed with the affected landowners
o Mark Desotel (Marinette County Highway Commission) and Chairman Heroux will conference call Kathleen Drews (Wisconsin Department of Transportation) to determine exactly what Kathleen Drews needs in terms of a Cost Effective Findings (CEF) to allow the TEA Project paperwork to proceed.
• Project P2008-03 ( resurface N 13th Road)
• Shouldering has been completed by Northeast Asphalt (NEA)
• Centerline and outside edge stripping has been painted by the Marinette County Highway Department

Plan Commission – Supervisor Gaffney
• A draft of the ordinance to create Chapter 9 of the Code of General Ordinances to create a joint municipal court has been reviewed and approved by Kim Coggins – Town Lawyer. The approved draft has been forwarded to the Village of Coleman for their review.
• A draft of the agreement between the Town of Pound and the Village of Coleman for the operation of a joint municipal court has been reviewed and approved by Kim Coggins – Town Lawyer. The approved draft has been forwarded to the Village of Coleman for their review.
• Biehl Construction has requested the installation of a culvert to allow pumping of water from their quarry on the south side of E 12th Road to the north side of E 12th Road. The water would then flow naturally to the Little Peshtigo River. Issues need to be addressed with the DNR and land owners with driveways along County Road B where the culverts froze last winter.

Board of Appeals
• Next Board of Appeals meeting is scheduled on Tuesday, October 21, 2008.

Recycle Center / Solid Waste Collection – Supervisor Gaffney
• New signs stating center hours and location of recycled materials have been installed.

Business Issues:
• Motion to approve Janelle Rymer to attend the Rabies control training session held Tuesday, October 28 in the Wisconsin Dells (includes session fee of $35.00 plus meals and travel) was submitted by Supervisor Semrau, seconded by Supervisor Pellman, carried 5/0
• Motion to set a public hearing date for the Peter’s Concrete request to re-zone Allen Noll’s parcels on N 9th Road (parcel 028-00587.000 and 028-22589.000) from A1 (Agricultural / Rural Residential) to Q-1 (Quarrying) on Tuesday, December 2, 2008 at 7:00 pm was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0
o Motion to have the Plan Commission chair the rezoning public hearing was submitted by supervisor Pellman, seconded by Supervisor Gaffney, carried 5/0
• Motion to schedule a special Town Board meeting to review and finalize the proposed 2009 Town budget and levy request on Monday, October 27, 2008 was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 4/1 (Supervisor Semrau voting – No).
• Motion to set the date for the 2009 Budget public hearing and hold a Town meeting to approve the levy on Tuesday, November 18, 2008 at 7:00 pm was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0
• Motion to approve Cindy Messenger as an election poll worker replacing Marian Zeitler was submitted by Supervisor Risner, seconded by Supervisor Semrau, carried 5/0.
• Motion to approve Clerk Peterson and Deputy Clerk Kaminski to attend the WisLine “Important Points to Remember for the November Election” and the WMCA District VIII meeting in Rhindlander on Wednesday, October 15, 2008 was submitted by Supervisor Gaffney, seconded by Supervisor Risner, carried 5/0

Motion to adjourn was made by Supervisor Pellman, seconded by Supervisor Semrau, carried 5/0 @ 8:40 pm
